SADC Administrative Tribunal (SADCAT)

Establishment and Jurisdiction

SADC Administrative Tribunal (SADCAT) was established by a Resolution of the SADC Summit meeting held in Gaborone, Republic of Botswana, on 18 August 2015 pursuant to Article 9(2) and 10(6) of the SADC Treaty.  SADCAT has jurisdiction to hear and determine labour disputes between SADC Secretariat or any of its institutions, as an employer, and an employee. This includes a dispute relating to the contract of employment of a staff or to the terms of appointment of such staff member.  The Tribunal is headed by an elected Judge-President and Vice-President who are assisted by a Secretariat.

Applicable Laws:

In deciding any application or appeal, SADCAT shall apply the internal rules and regulations of the SADC Secretariat or SADC Institution, internal policies on human resources and generally recognized principles of international administrative law concerning the resolution of employment disputes of staff in International Organizations.

Composition of the SADCAT Tribunal

The Tribunal is an independent institution of SADC. It has a pool of seven Judges from SADC Member States who are appointed by the Council of Ministers upon recommendation from the Committee of Ministers of Justice/ Attorneys General. The Tribunal has two levels of administration of justice; the First Instance and the Appeals Panel. A First Instance Panel can constitute of one (1) or three (3) Judges whereas an Appeals Panel can only constitute of three (3) Judges.

Currently, the Tribunal comprises of the following Judges:

  1. Judge President- Honourable Justice Dr Adelino Fernando Costa Muhongo, a Judge at the Civil and Administrative Chamber of the Provincial Court of Luanda in the Republic of Angola.
  2. Vice President- Honourable Lady Justice Mumcy Mju Dlamini, a Judge of the High Court in Kingdom of Eswatini. 
  3. Honourable Justice  Dr. Justice Sanji Mmasenono Monageng, a national of the Republic of Botswana.
  4. Honourable Justice Dr Albano Macie a Judge Member of the Constitutional Council of Mozambique.
  5. Honourable Lady Justice Gaitree Jugessur-Manna, a Judge at the Supreme Court of Republic of Mauritius.
  6. Honourable Lady Justice Latifa Mansoor, a Judge to the High Court of United Republic of Tanzania. 
  7. Honourable Justice Mr Rodgers Foroma Manyangadze serves as Judge in the High Court of Zimbabwe. 

Secretariat

The Secretariat is headed by the Secretary, Dr. Kuda Tshiamo-Kgati,  a national of the Republic of Botswana.

Time Limit

There is generally a period of ninety (90) days from the date of a final decision or omission to file an application before SADCAT and forty-five (45) days from the date of a decision or finding by the First Instance Panel to file an appeal.

An appeal can only be entertained if the First Instance Panel has:
a. exceeded its jurisdiction or competence;
b. failed to exercise jurisdiction vested in the Panel;
c. erred on a question of law;
d.  committed an error in procedure affecting the decision of the case; or
e. erred on a question of fact, resulting in a manifestly unreasonable decision.

Representation and Language

A litigant can appear in person or be represented by a member of the SADC staff association or a lawyer practising in any one of the SADC Member State before both levels of SADCAT. An application can be filed in any one of SADC official languages.

HON. JUSTICE DR. ADELINO F.C MUHONGO

Honourable Justice Adelino F. C Muhongo is the SADCAT Judge President. He is from the Republic of Angola. He is presently a Judge of Law in the Civil and Administrative Court appointed Judge since 2012 and exercising functions, placed in the Civil and Administrative Court Room, of the District of Belas, of the Judicial Province of Luanda, Angola. He is the founding member of Angola Judges Association - AJA and 1st Vice-President and president of Fiscal Council (2015 – 2021), which is member of International Judges Association – IAJ since 2017. He is also a member of International Judges Association Regional Africa Group and member of international Union Portuguese Languages Judges since 2015 as well as the World Intellectual Property Organization -WIPO forum member. He was also a University Professor at Óscar Ribas University/ Law Faculty, Taught Family Law, Succession Law, Tax Law, and Real Property Law in the fourth year of the law course (2011 – 2017).

He has received training on several legal, management and leadership courses including International Administrative Law (IAL) from University of Cape Town through JIFA (2024), Cape Town South Africa, Course on Civil Procedural Law, Executive Action and Precautionary procedures (2018); Course on Civil Law and Civil, Labor and Family Procedure (2017); training in Intellectual Property ( 2018) Geneva, Switzerland by WIPO and Training in Civil and Administrative Procedure of Appeal ( 2015). He speaks and writes Portuguese, English, French and Spanish fluently and Mandarin-beginner.

HON. JUSTICE MUMCY MJU DLAMINI

Honourable Justice Mumcy Dlamini serves as a Judge in the Southern African Development Community Administrative Tribunal (SADCAT) and is currently (2024) the Deputy President of the Tribunal. She is from the Kingdom of Eswatini. In 1998, she joined the Kingdom of Eswatini government and worked in the office of the Director of Public Prosecutions as the Crown Counsel.  She held this office until 2001 when she was transferred to the judiciary as a Senior Magistrate sitting in Mbabane, the capital city of the Kingdom.  Late 2002, she was recalled back to the office of the Director of Public Prosecutions where she took over the reigns as acting Director and later Director, a position she held until 2012.  In March 2012, she returned to the bench as a High Court Judge. 

During the course of her work as a Judge, and since 2013, she has been periodically appointed as the acting judge of the Supreme Court of the Kingdom and acting Judge of the Industrial Court of Appeal. Justice Mumcy Dlamini has undergone specialised training in the various positions she has held over the years in her career and therefore holds a number of related certificates from the Judicial Institute for Africa (JIFA) under the University of Cape Town and South African Judicial Education Institute (SAJEI) have taken a lead in her training as a Judicial Officer.

HON. JUSTICE RODGERS MANYANGADZE

Image removed.Honourable Justice Rodgers F. Manyangadze is a Judge of the High Court of Zimbabwe. He was appointed a Judge of the SADCAT in November 2022. The judge has had a long and varied career in the legal profession, spanning over 30 years. His work encompassed most aspects of the law, including commercial law, labour law, constitutional law, and criminal law.  He studied law at the University of Zimbabwe, where he graduated with a Bachelor of Laws Honours degree, and was registered as legal practitioner with the High Court of Zimbabwe. Before his appointment as judge of the High Court, Justice Manyangadze served as Judge of the Labour Court of Zimbabwe from 2013 to 2021, a period of 8 years. During this period, the Judge gained vast experience in presiding over labour disputes. These disputes emanated from both the private and public sectors and covered various applications and appeals.

From 2007 to 2013, Justice Manyangadze served as Legal Advisor in the Ministry of Industry and Commerce, Zimbabwe. As a lawyer working among economists, this position exposed him to the varied and complex world of commerce and industry. He was also involved in the work of multilateral organisations like COMESA, WTO and SADC, where he attended trade negotiation meetings and conferences. These included the European Union and Eastern and Southern African Economic Partnership Agreements and the SADC Customs Union negotiations.

Justice Manyangadze started his judicial career as a magistrate, rising through the ranks of the Magistracy from 1988 to 2006, before taking up the position of Legal Advisor described above. As a magistrate, he dealt with a wide range of criminal and civil matters, gaining valuable experience in the execution of judicial duties.

HON. JUSTICE LATIFA MANSOOR AL HINAIL

Image removed.Honourable Justice Latifa Mansoor Al Hinail is a highly competent in dispute resolution as she has been working with the Judiciary of Tanzania for 13 years. She also handled the Constitutional cases in the High Court of Tanzania, Main Registry. In 2022, Judge Mansoor was appointed the Judge of the Southern African Development Community Administrative Tribunal (SADCAT) for a four years Term representing Tanzania in SADCAT in November 2022.  Recently she was appointed the Justice of Appeal of the Court of Appeal of Tanzania in 2025. 

She served as the Judge in charge of the High Court Mediation Centre, High Court Tanga Zone and High Court Morogoro Zone from 2021 to the date of appointment to the Court of Appeal. She is the pioneer and encourages resolving disputes by Mediation and Arbitration. She advocates peace, security and protection of children’s rights. She believes in Teamwork and Cooperation at workplace.

HON. JUSTICE Dr ALBANO MACIE

Image removed.Honourable Judge Dr Albano Macie is Judge Constitutional Court of Mozambique, a position he has held from August 2019 to date. He is also a Law Professor at Eduardo Mondlane University, Maputo, Mozambique. He was appointed SADCAT Judge in 2022 and served as SADCAT Judge President from November 2022 to August 2024. From 2017 to August 2019, he worked as Peace Mediator Government of Mozambique, Maputo, Mozambique. This role entailed negotiating peace agreement for Mozambique, in order to stop political military hostilities between Government and Renamo forces; negotiating a decentralization model for Mozambique Government and Renamo and presenting solutions for peace, national reconciliation and development, amongst others. 

Interestingly, from March 2018 - July 2019 Justice Dr Albano Macies serves as Deputy-Minister Ministry State Administration and Public Worker in Maputo, Mozambique. He has published several books including Lectures on Administrative Law, 2021; Decentralization in Mozambique, 2021;  Public Worker Law Treaty, 2021 and Constitutional Law, 2023. He speaks Portugues and English fluently and French-beginner. He holds a PhD. In Law and Security from University of Nova the Lisbon, Lisbon, Portugal and a Masters in Public Law from Duardo Mondlane University, Maputo. 

HON. JUSTICE DR SANJI MMASENONO MONAGENG 

Image removed.Her Excellency Dr Sanji Mmasenono Monageng is a multi-faceted attorney and has held numerous prestigious appointments both in Botswana and internationally. Dr Monageng is from the Republic of Botswana.  She presently the Botswana High Commissioner to the Republic of South Africa and served as the Judge President of the SADCAT from 2022 to August 2024. She is a retired Judge of the International Criminal Court (ICC), The Hague, The Netherlands, where she served in the Pre-Trial Division (2009 -2012 and the Appeals Division (2012 – 2018) of the Court, where she served as the Court’s First Vice President (2012 to 2015). She was previously appointed as an expert High Court Judge in The Republic of The Gambia (2006 and 2007) and the Kingdom of Eswatini (2008 – 2009), under the auspices of the Commonwealth Secretariat, London, United Kingdom. Prior to that, she served as a Magistrate in the Courts of the Republic of Botswana (1987 – 1997). She is the founder Chief Executive Officer of the Law Society of Botswana (1997 to 2005).

Dr Monageng is a well-known and respected human rights expert having served as a Commissioner of the African Commission on Human and Peoples’ Rights, (the premier body that is mandated to promote and protect human and peoples’ rights on the African continent), which is also an organ of the African Union (2003 – 2009), and as its Chairperson (2007 to 2009).  She has served as a member and President of the Botswana National Gender Commission, which Commission is tasked with advising government on gender issues, particularly on policy development and service delivery. She has been bestowed awards by the Botswana Government - the Presidential Order of Honor, awarded by HE, Dr Mokgweetsi Masisi, the President of Botswana for outstanding service to Botswana, and the International Association of Women Judges – a Human Rights Award for an exemplary judicial career, commitment to protect and promote human rights, women’s and children’s rights and distinguished service for national and international human rights institutions.

HON. JUSTICE GAITREE JUGESSUR-MANNA

 Honourable Justice Gaitree Jugessur-Manna is a distinguished Judge with over 30 years of experience in the legal field. She is from Mauritius. Having earned a reputation for fairness and thorough acumen, Justice Jugessur-Manna has presided over a wide range of cases, from murder trials, complex commercial disputes, medical negligence disputes, election petitions, constitutional and administrative disputes to sensitive family matters, ensuring that justice is served and seen to be served.  Throughout her career from State Counsel, District Court Magistrate, Assistant Solicitor General, Master and Registrar and as a Judge, she has demonstrated impartiality and her commitment to uphold the rule of law while adapting to the evolving dynamics in the legal landscape in Mauritius. 

Honourable Justice Jugessur-Manna has a deep understanding of criminal law, commercial law, family law, civil law, constitutional law and administrative law, making her a valuable asset to the SADCAT. Her expertise in navigating the complexities of governance and regulatory frameworks coupled with her ability to analyse intricate legal issues and deliver well-reasoned judgments has equipped her to adjudicate an array of cases involving public bodies, ensuring accountability, fairness and transparency. Beyond the courtroom, Justice Jugessur-Manna is a contributor to legal seminars. She was appointed as Judge of the SADCAT in November 2022.

SADCAT SECRETARY 

Image removed.Dr Kuda Tshiamo-Kgati a Motswana female attorney admitted to practice law in all courts of the Republic of Botswana as an attorney, conveyancer and notary public since 2012. She is an award-winning attorney having been awarded 2021 Africa General Counsel of the Year by Africa Legal. She is also the recipient of the Strategic African Women in Leadership Trailblazers Awards 2020. In November 2021, she was selected amongst other 30 African Legal Executives to attend Executive Legal Training on Investment Arbitration offered by ICSID (World Bank) and Africa Arbitration Academy. She currently serves at the SADC Administrative Tribunal Secretary. 

She has over thirteen years’ experience and has held several executive positions in the Corporate sector including, Company Secretary and Head of Compliance at Continental Reinsurance (Botswana); Head of Legal Services at Botswana Telecommunications Corporation (BTC) and Senior Litigation Counsel at Citizen Entrepreneurial Development Agency (CEDA). She also serves as an Independent and Non-Executive Director in several boards in Botswana. She obtained Certified Director certification from the South Africa Institute of Directors in 2024. 

She holds a PhD from the University of Pretoria, South Africa; a master’s degree in international Trade and Investment Law (LLM) from the University of Pretoria in conjunction with Amsterdam University, Netherlands; a Master of Business Administration (MBA-International Business) holder obtained from Amity University through Botswana College of Distance and Open Learning and a law degree from the University of Botswana and several leadership and management certificates.  She also received Judicial training on International Administrative Law (IAL) and Judgement writing offered by the Judicial Institute for Africa (JIFA) in 2024, through the University of Cape Town, South Africa. 

SADCAT ADMINISTRATIVE SECRETARY 

Image removed.Ms Reginah Dikgang joined SADC in 2005 as a secretary and was seconded to SADCAT in 2018. Her role entails proper upkeep of the Tribunal, engagements with SADCAT stakeholders, preparations and logistics for hearing sessions, Judges trainings and Plenary meetings. Ms Dikgang is a natural leader, and her organizational skills are exceptional. She possesses solid writing skills, which have enabled her to compose and produce quality correspondence. She holds a Diploma in Secretarial Studies and has received several trainings on upgrading Judicial Secretarial skills; customer service excellence; office management and interpersonal communication strategies amongst others. 

Ms. Reginah Dikgang also holds a Degree in Human Resources and Industrial relations from Botswana Open University.
